What Is the GDPR?

The General Data Protection Regulation (GDPR) is a Europe-wide law that replaced the Data Protection Act 1998 in the UK. In the UK, it now operates alongside the Data Protection Act 2018. The regulations took effect on 25 May 2018 and set out how organisations must collect, use, and protect personal data.

Rushwick Parish Council acts as both a Data Controller and a Data Processor. This means we are responsible for deciding how and why personal data is used, and for processing that data in line with the law. As part of this, we provide Privacy Notices to explain how we use personal information and what rights individuals have over their own data.

 

Data Protection Officer

Under Section 7(3) of the Data Protection Act 2018, parish councils are not classed as public authorities for the purposes of the GDPR, so there is no legal requirement for us to appoint a formal Data Protection Officer. However, we take our data protection responsibilities seriously and remain fully subject to data protection legislation.

Information Commissioner’s Office (ICO)

Rushwick Parish Council is registered with the Information Commissioner’s Office as a data controller. Our registration can be found on the ICO’s public register.

Security Under the GDPR

The Council has carried out an assessment of the personal data it holds, documenting what is collected, why it is collected, and how it is protected. We have also completed a GDPR risk assessment to identify and manage any risks to the security of personal data. Both of these are reviewed on a regular basis to make sure our practices stay up to date.

 

Privacy Notices

We publish separate Privacy Notices explaining how we handle personal data for different groups, including:

  • Councillors and Council staff
  • job applicants
  • residents contacting the Council
  • visitors to this website
